Of course, the rules must be followed. But state control should not ruin. Its goal is to make everyone work correctly. Business should bring joy to people at reasonable prices, and not create risks. That is why it is planned to make the punishment system more flexible. And work on this has been going on for a long time.

As Vladimir Gruzdev, Chairman of the Board of the Association of Lawyers of Russia, explained, one of the projects prepared by the Ministry of Justice clarifies a number of provisions of the Code of Administrative Offenses in order to expand the application of a fifty percent discount on the payment of an administrative fine by business entities.

It should be recalled that not long ago the law established the possibility of paying an administrative fine for entrepreneurs with a fifty percent discount.

“The rules are similar to those that apply to drivers who violate the Traffic Regulations,” said Vladimir Gruzdev.

All drivers know: if you pay a fine right away, without delay, you can pay only half the amount. It is difficult to find a driver who would not like this situation. Exactly the same fine rules have recently been adopted for businesses.

“However, in practice, a problem has arisen: law enforcement officials do not extend the provisions on preferential payment of fines to cases where the violation was identified by the prosecutor’s office,” says Vladimir Gruzdev, Chairman of the Board of the Association of Lawyers of Russia. “The Constitutional Court of the Russian Federation found this provision to be inconsistent with the Basic Law.”

The proposed project rectifies the situation. Now it will not matter who exactly discovered the violation. Another initiative supplements the Code of Administrative Offenses with a norm allowing violators to negotiate with state inspections: violations can be corrected without punishment.

It should be emphasized that the agreement will be official, everything is fair and transparent: some are corrected, others are not punished or are punished mildly. As experts explain, the proposal may be of interest to businesses first and foremost. But budgetary institutions, in which inspectors find some shortcomings, will also be able to conclude agreements.

As Vladimir Gruzdev told “RG”, the draft law proposes to provide for a mechanism for concluding an agreement between a person brought to administrative responsibility and an authorized state body. According to him, the execution of the concluded agreement will be the basis for releasing the person from administrative responsibility.
